WHEN TO USE THIS DOCUMENT

These terms and conditions are suitable for use in England, Wales and Scotland by a website designer when providing services to customers. It does not matter whether the customer is a businesses or a person (consumers).
 
The agreement allows a website designer to set out the standard terms on which they will provide work to the customer. For the terms and conditions to be effective the website designer must attach them to the proposal or can put them on the reverse of the proposal. Whichever way, the customer should be aware of the website designer’s terms and conditions before agreeing to the proposal so that they become part of the agreement between the website designer and the customer.

The terms and conditions can also be used for electronic purchases using electronic signatures, tick box or agreement by e-mail etc. However the website designer must still supply the terms and conditions and proposal to the customer before the order is finalised. The terms provide for a customer who may have rights under Distance Selling Regulations to waive those rights unless the website designer agrees otherwise.

  • The proposal ready for the website designer to customise details of the work and price for the customer
  • Details of the service, delivery and products
  • The price and how payment will be made
  • The obligations of both the customer and the website designer
  • Cancellation and termination
  • responsibility for any products supplied (e.g. trolley, checkout etc)
  • Guarantee (if required)
  • Default
  • Property and Risk
  • Warranty
  • Liability limitation
  • Indemnity
  • Intellectual property

DO NOT USE THIS DOCUMENT

  • for any supply other than a website designer.
  • for supply of website hosting only 
  • for supply of website design + hosting supplied at the same time
