TENANCY DEPOSITS TERMS & CONDITIONS

These terms and conditions are suitable for use in England, Wales and Scotland by a landlord and tenant with respect to the holding of a tenancy deposit.

What the terms and conditions contain

The following agreement provides a framework within which the monies paid over by a tenant as a tenancy deposit under a deposit scheme are held.  It contains agreement as to how the deposit will be held and how it will be returned at the end of the tenancy. It also deals with the procedure for resolving disputes about the tenancy deposit between the landlord and tenant. 

How to use the terms and conditions and why you should use them


Before the tenancy deposit is paid over by the tenant to the deposit scheme, these terms and conditions should be agreed by both parties and required information inserted as indicated. Once this is done and the terms and conditions are signed then they become effective as the set of guidelines that will govern the landlord and tenant relationship with respect to the tenancy deposit.

Agreeing the basics of the tenancy deposit in advance will save both time and money in the long run, should any disputes or queries arise further down the line.  Having everything clearly set out in writing – and signed – means that both the landlord and the tenant know exactly how the deposit is to be held, protected and returned.

Standard content

These terms and conditions contain the minimum requirements for the holding of a tenancy deposit.  They cover standard content such as:

 

  • Information on the deposit that is being held, including the amount of the -deposit and the fact that it is protected under the Housing Act 2004
  • The details of the deposit scheme under which the deposit is to be held
  • The procedure for the return of the deposit at the end of the tenancy
  • The procedure for resolving disputes as to the return of the tenancy deposit

This document is specifically aimed at the holding of a tenancy deposit

This document will not provide an effective structure for any other service other than the holding of a tenancy deposit.
