WHEN TO USE THIS DOCUMENT
These standard terms and conditions are for use when selling digital content that can be downloaded from a website. Digital content includes most downloads including music, video clips, “books”, podcasts.
These terms assume that the seller wants to keep “ownership” of the digital content and simply give the user / buyer a non-exclusive licence to use it once they have paid the price displayed on the website.
These standard terms and conditions will cover the basics of most sales to buyers whether they are members of the public (consumers) or to other businesses. They set out the basics of how you will sell and supply your downloads. So, for example, it will deal with your obligations and what you supply but will also deal with the buyer’s obligations and responsibilities (for example with regard to use of the downloads). It also covers potential issues such as problems with payment etc.
The document has various options so you can customise it to suit what you need.
The Standard terms and conditions should be part of the ordering process and available to read before the order is placed. You will also need to send an order confirmation, usually sent by email, which will confirm exactly what the buyer is buying. This basic information that you will need to send the buyer is also included.
