EMPLOYMENT AGENCY TERMS AND CONDITIONS PACK

WHEN TO USE THIS PACK

 This Pack contains all that a recruiter organisation or an Employment Agency needs to set up an ongoing Agreement with a prospective employer (the business who needs workers / staff.) to find and introduce suitable candidates to that prospective employer.

 The standard terms and conditions set the foundations of the relationship between the recruiter and client business and cover the usual basic clauses that are expected in this type of agreement. The format of the agreement allows you to use it as a Master Agreement between the recruiter and the same client business for a number of recruitment drives or fill several different positions so that a brand new terms and conditions do not have to be dealt with each time.

 Instead this format relies on a separate Project Sheet which allows the recruiter and the client business to specify exactly what they want for each recruitment drive or each position the client business wants to fill. For example, the Project sheet will specify details of what type of candidate they are looking for etc, but can also deal with any variations to the standard terms and conditions such as a variation in cost or a shorter time to pay etc.

 This pack is for both the Master agreement and a template project sheet.

Master Agreement contains:

• Full definitions, including defining who are candidates and what constitutes an “introduction” from the recruiter to the client business.
• Payment – allows for reduction of fees is the candidate does not stay with the client business for at least an agreed length of time (e.g. 3 months).
• Introductions – definition and when payment is triggered.
• Responsibilities of recruiter and client business.
• Limitation of liability.
• Data Protection.

Project Sheet contains:

• Definition of the services needed.
• Details of when they must be provided by.
• Details of where the services must be provided.
• The price for those services.
• Any special specifications or conditions (for example, something that may make changes to the Master Agreement).

DO NOT USE THESE DOCUMENTS

• For anything other than a recruiter – please see our other documents.
• If you intend to create any form of employment contract.
• If you need specialist documents for agencies who will act as employers etc.
