RESIDENTIAL ROOM LICENCE AGREEMENT


WHEN TO USE THIS DOCUMENT

 This agreement is for use when you want to rent a room in a residential premises / a home (a house or flat etc) to one or more “tenants” (licensees).

 This document is a licence, not a lease. This means that the licensee will not be getting “exclusive possession” of the property. Think of a licence as being similar to using a hotel room. You don’t have a tenancy agreement for the room; you simply have a right to use the room for a defined period (e.g. overnight), until you must vacate the room the following morning.  You also have the use of services as part of that right (electricity, room cleaned etc).

 So, this licence document means that the licensor allows the licensee to use the room for whatever period of time is agreed and whilst the licensee pays the licence fee (“rent”). It generally also includes the use of services – you customise what is and is/not included such as electricity, internet, heating and cleaning, insurance contribution etc.

 However, you still need a written document and this agreement covers the basic issues such as how long the licence will be for and what licence fee (“rent”) is to be paid, how it will be paid etc and what happens if it is not paid. It also clarifies the licensee’s responsibilities and what can and can not be done on the premises.

 The document is intended to protect both the licensor and the licensee so that everybody is aware of their obligations and responsibilities.

WHAT DOES IT CONTAIN?

 The usual information you would expect to see in la licence like this which you customise, including:-

  • Licence  basics – how long for etc.
  • Licence fee (“rent”) – how much and when it will be paid.
  • What happens if licence fee is not paid (landlord’s re-entry rights).
  • What services are included.
  • Obligations and responsibilities.
  • Termination – ending the licence agreement.
